Las Vegas, NV is known across the globe as an entertainment hotspot, with its colorful hotels and casinos that attract literally millions of visitors every year. All this tourist activity also helps support a number of other businesses around the city. Starting a business in Vegas can certainly put you on the path to prosperity—but, as usual, there is a certain amount of “red tape” you must deal with. This includes obtaining a kind of business license known as a seller’s permit

A seller’s permit goes by many names, including resale license, wholesale license, sales and use tax permit, sales tax permit, and reseller permit. In Las Vegas, it’s generally called a Nevada Sales/Use Tax permit. By whatever name you call it, though, this license always has the same purpose: It gives businesses the authority to collect sales tax on retail transactions.

In Nevada, it is customary to apply for a Sales/Use Tax permit when registering your business. If you’re not sure how to go about doing that, FastFilings is here to help. With our online ordering platform, it takes just a few minutes to get the process started. You’ll have your Las Vegas seller’s permit shortly.

Who Needs a Wholesale License in Las Vegas?

You must have a valid Nevada seller’s permit if your Las Vegas business is engaged in selling “tangible personal property” on a retail or wholesale basis anywhere in the state. This requirement also applies to out-of-state businesses that enter Nevada to conduct operations.

You will be required to pay a separate sales tax fee for each business location you operate. Note that certain types of physical property are not subject to the Nevada sales tax, such as food, fertilizer, petroleum, and prescription medication.

Certain religious, charitable, and educational organizations are exempt from the requirement to collect sales/use tax. There are no annual or recurring fees associated with maintaining your seller’s permit in Las Vegas.

Seller's Permit Vs. Resale Certificate in NV

It is important to understand that your Nevada wholesale license is not the same as a Nevada resale certificate. While your wholesale license/seller’s permit authorizes you to collect sales tax, a resale certificate performs a different function. A resale certificate in Las Vegas gives you the right to purchase tangible goods tax-free on the condition that you resell them later. This certificate is not intended to be used to purchase equipment or supplies for your place of business (e.g., computer monitors for in-house employees).

If you are involved in purchasing goods through these kinds of transactions, you will be required to fill out a resale certificate and give it to the seller.
