Who Needs a Wholesale License in Las Vegas?

You must have a valid Nevada seller’s permit if your Las Vegas business is engaged in selling “tangible personal property” on a retail or wholesale basis anywhere in the state. This requirement also applies to out-of-state businesses that enter Nevada to conduct operations. 

You will be required to pay a separate sales tax fee for each business location you operate. Note that certain types of physical property are not subject to the Nevada sales tax, such as food, fertilizer, petroleum, and prescription medication.

Certain religious, charitable, and educational organizations are exempt from the requirement to collect sales/use tax. There are no annual or recurring fees associated with maintaining your seller’s permit in Las Vegas.

It is important to understand that your Nevada wholesale license is not the same as a Nevada resale certificate. While your wholesale license/seller’s permit authorizes you to collect sales tax, a resale certificate performs a different function. A resale certificate in Las Vegas gives you the right to purchase tangible goods tax-free on the condition that you resell them later. This certificate is not intended to be used to purchase equipment or supplies for your place of business (e.g., computer monitors for in-house employees).
